Terms and Conditions

These Terms and Conditions (T&Cs) set out the agreement between a school, a Parent Teacher Association (PTA) or Parent Council (PC), (hereafter referred to as 'beneficiary’),which has registered on The Parents Lottery website and Parentkind Enterprises Ltd, a company incorporated in England and Wales (registration number 03884281) having its registered office at 82A James Carter Road, Mildenhall, IP28 7DE and authorised as a Remote Operator by the Gambling Commission of GB (Remote Operator number: 000-057904-R-333479-002).
By registering with The Parents Lottery, you agree to be bound by these T&Cs and that they will apply to the exclusion of any other terms and conditions.
Definitions:
In these T&Cs, the following words mean :
  1. ‘Agreement’ means the agreement between you and us as governed by these T&Cs.
  2. ‘Applicable Laws’ means all applicable laws, statutes, regulations and codes from time to time in force, including the Gambling Act 2005 (as amended from time to time) and the Data Protection Laws
  3. ‘Authorised Person’ the person who has authority from your school, PTA or PC to register the organisation as a beneficiary of The Parents Lottery
  4. ‘CFP Raffles and Lotteries Ltd’ are an External Lottery Manager (ELM) authorised by the Gambling Commission under account number 584.
  5. ‘Chances’ Tickets purchased to be entered into the draws by Players. Chances will only be entered into draws if the Player has sufficient credit to do so.
‘Confidential Information’ means any and all information which relates to the business affairs, products, developments, trade secrets, know how, personnel, customers and suppliers of either party or which is marked ‘confidential’ or information which may reasonably be regarded as the confidential information of the disclosing party, save that Confidential Information will not include any information independently known to a party or is in the public domain, other than as a result of a breach of section 16 (Confidentiality).
‘Data Protection Laws’ means the UK GDPR, Data Protection Act 2018 (as amended from time to time) and any other law of the United Kingdom or a part of the United Kingdom which relates to the protection of personal data
  1. ‘Donations’ means any amount donated by the player to their chosen Registered Beneficiary when purchasing tickets. This can be either through ‘Keep the Change’ if they pay by Direct Debit or a specified amount if paying by Debit Card. The Donation is in addition to the ‘Share of Proceeds’ defined below and is collected on behalf of the chosen Registered Beneficiary by Parentkind Enterprises Ltd.
  2. ‘Gross Ticket Proceeds’ means the gross amount paid to us on a monthly basis from the purchase of Lottery chances by Players.
  3. ‘Intellectual Property Rights’’ means patents, rights to inventions, copyright and neighbouring and related rights, moral rights, trademarks and service marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs rights in computer software, database rights, rights to use, and protect the confidentiality of Confidential Information and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.
  4. ‘Licence Conditions’ mean the Licence Conditions and Codes of Practice of the Gambling Commission or other relevant licencing authority applicable to us or you from time to time.
  5. ‘Lottery’ means a lottery promoted by Parentkind Enterprises Ltd and operated on behalf of Parentkind Enterprises Limited by CFP Lottery and Raffles Ltd (CFP)
‘Lottery Chances’ means lottery numbers purchased by a Player which are entered into the weekly draws for the length of time they have credit to be entered for
‘Lottery Draw Date’ means the date of the first draw in which tickets purchased by Players are eligible to be entered. All Lottery draws take place on a Friday (in the event of a Bank Holiday Weekend, that week’s draw will be conducted on the next working day)
‘Parentkind’ is a charity registered under Charity number: 1072833
  1. ‘Parentkind Good Causes’ means causes which support Parent Teacher Associations (PTAs), schools, and parents in improving the life outcomes of children. These Good Causes include, but are not limited to: assisting PTAs in addressing the most pressing needs of their school communities, ensuring that children and young people have the resources they need to learn, grow, and thrive; helping schools to strengthen partnerships with parents so that children can achieve more; and providing practical support to parents to enable them to confidently navigate the challenges of parenthood and support their children’s education.
  2. ‘Player’ means any person who has paid the required amount to enable them to be entered into a draw of a Lottery and who will be and continue to be a Player until that person ceases to be a Player for whatever reason.
  3. ‘Player Personal Data’ the personal data of Players collected through their participation in the Lottery
  4. ‘The Parents Lottery’ means the Lottery, website and platform, located at www.theparentslottery.org
  1. ‘PC’ means a Parent Council who is a fundraising team associated with an education establishment registered with Education Scotland
  2. ‘PTA’ means a Parent Teacher Association or school Parent Body or parent fundraising team associated with an educational establishment registered with the Department for Education in England or Wales or Education Scotland
  3. ‘Registered Beneficiary’ means a PTA , PC or school registered with the Parents Lottery
  4. ‘School’ means a school registered with the Department of Education in England or Wales or Education Scotland
  5. ‘Share of Proceeds’ means the share of the Gross Ticket Proceeds allocated to you, calculated as a percentage of the Gross Ticket Proceeds.
  6. ‘UK GDPR’ has the meaning given to it in Section 3 (10) of the Data Protection Act 2018 (as amended from time to time)
1. The Parents Lottery
  1. 1.1  The Parents Lottery is promoted by Parentkind Enterprises Ltd and administered on its behalf by CFP Raffles and Lotteries Ltd.
  2. 1.2  Gross Ticket Sales are the property of Parentkind Enterprises Ltd
  3. 1.3  The Parents Lottery raises funds for Schools, PTAs and PCs who are registered as beneficiaries of the Lottery
  4. 1.4  Only Registered Beneficiaries will benefit from the Lottery’s Gross Ticket Proceeds
2. Beneficiaries Lottery Registration
  1. 2.1  Your organisation must be a School, PTA or PC as defined in the Definitions
  2. 2.2  The School, PTA or PC must have a UK bank account in your organisation’s name that we can deposit your Share of Proceeds percentage and donation proceeds, for which you are named a beneficiary, via a BACS transfer. Share of Proceeds percentages and donations will not be transferred to any other bank account other than one which matches the School, PTA or PC name.
  3. 2.3  By registering as a beneficiary with the Lottery, you confirm that the Share of Proceeds are to benefit the education and well-being of children in the school and not for any third-party cause, whether charitable in status or not.
  4. 2.4  The person registering your School, PTA or PC is the Authorised Person
  5. 2.5  The Authorised Person agrees to maintain the organisation’s details and to administer their organisation’s lottery page and make decisions on the organisation’s behalf in connection with the Parents Lottery
  6. 2.6  You warrant that all information provided when registering is true and correct.
  7. 2.7  Parentkind Enterprises Ltd and/or it’s ELM, CFP Raffles and Lotteries Ltd, reserve the right to refuse or cancel your School, PTA or PC’s registration at any time should you not meet the criteria to register, do not adhere to these T&Cs or bring either the Promotor, Administrator or the Lottery into disrepute.
  8. 2.8  Registration with the Parents Lottery does not guarantee that your School, PTA or PC will receive a Share of Proceeds percentage
  9. 2.9  A Registered Beneficiary can be terminated and their account removed from the Parents Lottery site, having been given 30 days written notice, under the following circumstances: -
    1. (i)  Where the beneficiary has not generated at least one ticket sale within the previous 12 months.
    2. (ii)  Where after registration the beneficiary has not generated at least 1 ticket sales in the subsequent 6 months following the initial ticket sale.
    3. (iii)  Where the registration has not maintained contact details.
    4. (iv)  Where the registration is incomplete i.e. does not have bank details
    5. (v)  Where the Lottery becomes aware that the beneficiary no longer exists as an entity
For the effects of termination see Section 5
By registering with the Lottery you confirm your acceptance of these T&Cs.
3. Term of Registration
  1. 3.1  A beneficiary’s registration will be considered valid on a rolling termly basis, except in the case of 2.9. There is no minimum or maximum registration term.
  2. 3.2  Should you wish to terminate your registration; you may do so by giving six weeks’ notice in writing to be sent to:

4. Changes to these Terms and Conditions
  1. 4.1  Parentkind Enterprises Ltd may amend these Terms and Conditions from time to time where reasonably necessary to:
    1. (i)  comply with legal and regulatory requirements
    2. (ii)  reflect changes to the operation or administration of The Parents Lottery
    3. (iii)  improve the services provided through the Parents Lottery or
    4. (iv)  reflect changes in business practice; or
    5. (v)  amend the allocation or distribution of Gross Ticket Proceeds, including the Share of Proceeds payable to Registered Beneifiaries
  2. 4.2  Where a proposed amendment if material and may affect a Registered Beneficiary’s rights, benefits or obligations, Parentkind Enterprises Ltd will provide not less than 28 days’ written notice of the change.
  3. 4.3  A Registered Beneficiary who does not wish to continue under the amended Terms and Conditions may terminate its registration by providing written notice within 14 days of receiving notification of the amendment
  4. 4.4  Continued participation in The Parents Lottery after the effective date of the amendment shall constitute acceptance of the amended Terms and Conditions to the extent permitted by applicable law.
5. Effects of Registration Termination
Upon termination of a Registered Beneficiary’s participation in The Parents Lottery:
  1. 5.1  Parentkind Enterprises Ltd will pay the Registered Beneficiary any remaining Share of Proceeds percentage and donations, within 14 days of the published payment dates following termination as per Clause 9 of these T&C’s.
  2. 5.2  The Registered Beneficiary’s account with the Lottery will be frozen and the beneficiary will not have access to the account
  3. 5.3  The Registered Beneficiary will cease to promote the Lottery
  4. 5.4  The Registered Beneficiary will cease to use the Lottery promotional materials with immediate effect and return or destroy all such material(s) in its possession
  5. 5.5  The Registered Beneficiary’s Lottery page will no longer be visible on the Lottery website or any associated material
  6. 5.6  Players will be able to buy Chances in the Lottery but not specify your organisation as their chosen beneficiary nor give a donation to your organisation via the Lottery
  7. 5.7  The Parents Lottery will write to Players who have nominated you as their beneficiary to notify them of your organisation’s registration termination. They will be given the option to nominate another beneficiary or terminate their Chances in line with the Player T&C’s printed on the Lottery website.
6. Gross Ticket Proceeds
  1. 6.1  All Gross Ticket Proceeds remain the property of Parentkind Enterprises Ltd until they are allocated at the discretion of Parentkind Enterprises Ltd in accordance with these Terms and Conditions.
  2. 6.2  The Gross Ticket Proceeds are divided as follows:
From 1st September 2026, for every £1 Chance purchased by a player on the Parents Lottery site with a Registered Beneficiary nominated by the player, Gross Ticket Proceeds shall be allocated as follows:
  1. (i)  56% will go to the nominated Registered Beneficiary who retains paid PTA Membership by Parentkind for the school term in which the draws are held
  2. (ii)  A nominated Registered Beneficiary who has not retained paid PTA Membership by Parentkind, or who is a School, for the school term in which the draws are held will receive 42% of the Gross Ticket Proceeds.
  3. (iii)  The difference in the Gross Ticket Proceeds, between Clause 6.2 (i) and 6.2(ii) being 14%, will be retained by Parentkind Enterprises Ltd and allocated to either Parentkind’s Good Causes, prizes for the Parents Lottery or the expenses of the Parents Lottery
  4. (iv)  The remainder of the Gross Ticket Sales are distributed as follows:
  5. (v)  18.18% towards prizes
  6. (vi)  21.82% for administration of the Lottery
  1. 6.3  Should Chances be purchased with Parentkind as the beneficiary, Parentkind reserves the right to distribute 56% of the Gross Ticket Proceeds to Parentkind’s Good Causes as determined at the time of distribution
  2. 6.4  Should a Registered Beneficiary, who at the time of registration held a paid PTA Membership with Parentkind, not renew their subscription with Parentkind for the subsequent year, they may continue with their Lottery registration. However, as a Registered Beneficiary their Share of Proceeds percentage will be reduced to 42% from the term following their failed renewal date and will continue at the reduced rate of 42% unless 6.5 applies. This clause does not apply to Schools who should refer to 6.2(ii)
  3. 6.5  Should a Registered Beneficiary fail to renew their paid PTA Membership with Parentkind on their renewal date but subsequently renews their subscription within 30 days of the renewal date they will receive 42% as their Share of Proceeds Percentage between their failed renewal date and up to six weeks after their renewal is processed by Parentkind. After this time they will receive 56% as their Share of Proceeds Percentage. Should they renew 30 days or more after their renewal date 6.6 will apply. This clause does not apply to Schools who should refer to 6.2(ii)
  4. 6.6  Should a Registered Beneficiary not hold paid PTA Membership by Parentkind at the time of Lottery registration but subsequently subscribes to paid PTA Membership by Parentkind, then the Share of Proceeds Percentage will be applied at 56%. This will be applied from the term after the paid PTA Membership by Parentkind is processed and will not be back dated. This clause does not apply to Schools who should refer to 6.2(ii)
  5. 6.7  There are no alternative payment options available
The allocations and percentage distribution set out in this Clause 6 may be amended from time to time in accordance with the Changes to these Terms and Conditions provisions of these T&Cs.
7. Beneficiary Selection
  1. 7.1  Once registered with the Lottery, the Registered Beneficiary will be searchable by school name or school post code on the Lottery website.
  2. 7.2  Players will be able to select a Registered Beneficiary as their preferred recipient of the allocated Share of Proceeds as calculated by clause 6.2.
  3. 7.3  Players may choose to select as many Registered Beneficiaries as they wish to, however only one Registered Beneficiary can be selected per individual Lottery Chance.
8. Direct Donations and Keep the Change
  1. 8.1  When purchasing a Lottery Chance, Players will be given the opportunity to top up their purchase with a regular (Keep the Change) or singular (direct) donation to their preferred Registered Beneficiary.
  2. 8.2  Any donation in support of a Registered Beneficiary will be collected by Parentkind Enterprises Ltd on the Registered Beneficiary’s behalf
  3. 8.3  Payment of donations will be made in line with payment dates set out in clause 9.
  4. 8.4  Where the Player choses to complete a Gift Aid declaration, the Gift Aid claimant will be Parentkind (Registered Charity No: 1072833) and no collected Gift Aid, or a portion of the Gift Aid, will be given to the chosen beneficiary.
  5. 8.5  Any Gift Aid collected by Parentkind will be used at the sole discretion of Parentkind
9. Payment
  1. 9.1  Payment of the appropriate Share of Proceeds Percentage and Donations will only be made into a bank account in the name of the beneficiary.
  2. 9.2  Payments will be made by BACS transfer only
  3. 9.3  Payment will be made within 14 working days of the last day of term as decided by Parentkind Enterprises Ltd
From 1st September 2026, until further notice, the last day of term will be as published by Kent County Council at https://www.kent.gov.uk/education-and-children/schools/term-dates.
  1. 9.4  For administrative purposes there is a cut-off date to which the Share of Proceeds Percentage are calculated. The cut-off date will be the last Friday in the month before the payment dates specified in 9.3.
  2. 9.5  For this reason the Share of Proceeds Percentage paid in accordance with 9.4 may differ from the amount shown on the beneficiary’s Lottery account area
  3. 9.6  Any Share of Proceeds Percentage due between the last Friday in the month before the payment dates specified in 9.3 and the payment date will be carried over to the next payment date
  4. 9.7  Parentkind Enterprises Limited reserve the right not to distribute funds to beneficiaries who have:
    1. a)  Not adhered to these T&C’s
    2. b)  Be found to bring Parentkind Enterprises Ltd, Parentkind, Parentkind Trading Ltd, Parent Friendly Schools Ltd or The Parents Lottery into disrepute
    3. c)  Allowed the Lottery to be promoted by or to anyone under the age of 18
    4. d)  Engaged in any activity deemed illegal by the courts in England and Wales or Scotland and/ or set out in legislation whether enacted by the UK Parliament or devolved legislation enacted by the Scottish Parliament, Senedd/Cymru /Welsh Parliament or any other devolved administrations
    5. e)  Found to have entered into any activity, either knowingly or unknowingly, which either/or is contra to the Gambling Act 2005 (as amended from time to time) and/or any regulations set out by the Gambling Commission
    6. f)  In the event any of the above occurs the Registered Beneficiary will be notified and the Termination clauses followed. Any Share of Proceeds Percentage due to that Registered Beneficiary will be applied to Parentkind’s Good Causes.
10. Share of Proceeds Percentage Settlement threshold
  1. 10.1  Payment of Share of Proceeds Percentage due to the Registered Beneficiary will be paid in accordance of clause 9 where the total amount to be paid exceeds a settlement threshold of £20.
  2. 10.2  Where the total amount payable to a Registered Beneficiary is less than £20, the balance will be carried forward and combined with future Share of Receipts Percentage amounts until the total payable reaches £20 or more, at which point payment will be made as part of the next scheduled payment run under Clause 9.
  3. 10.3  Should the total Share of Proceeds Percentage, which falls below the settlement threshold, remain below the settlement threshold for two consecutive payment dates as set out in 9.3, the funds will be paid on the last payment date of the calendar year regardless of value.
  4. 10.4  All accrued amounts remain fully allocated to the Registered Beneficiary. Such amounts shall not be subject to deduction, forfeiture, expiry or reallocation solely because they fall below the minimum payment threshold.
  5. 10.5  Direct Donations and Keep the Change Donations received on behalf of a Registered Beneficiary will be allocated to that Registered Beneficiary upon receipt and recorded as amounts due to that Registered Beneficiary. Such amounts will remain fully allocated to the Registered Beneficiary until paid. For administrative efficiency, Direct Donations and Keep the Chane Donations may be held and paid in accordance with the settlement threshold and payment arrangements set out in Clauses 9 and 10 and may be combined with any Share of Proceeds due. No Direct Donation or Keep the Change Donation shall be subject to deduction, forfeiture, expiry or reallocation solely as a result of the settlement threshold applying.
11. Protection of Funds
  1. 11.1  We are required by our licence to inform customers about what happens to funds which we hold on account for you in the event of insolvency. The Gambling Commission provides further information on our licence conditions detailing what we need to tell customers about their funds.
  2. 11.2  We hold customer funds separate from company funds. These funds are not protected in the event of insolvency: not protected segregation. For more information, please see the customer funds insolvency ratings system
12. Marketing Materials
  1. 12.1  Only marketing materials provided or authorised by Parentkind Enterprises Ltd may be used in the promotion of The Parents Lottery
  2. 12.2  Promotional materials remain the property of Parentkind Enterprises Ltd
  3. 12.3  Promotional materials provided by Parentkind Enterprises Ltd may not be used for any reason other than to promote The Parents Lottery
  4. 12.4  As prescribed in 5.3 and 5.4 above, upon termination of registration in The Parents Lottery your organisation will cease to use any promotional materials provided by Parentkind Enterprises Ltd with immediate effect
13. Liability
  1. 13.1  Neither CFP, Parentkind Enterprises Ltd, Parentkind or any of the Beneficiaries participating in the Lottery from time to time shall be liable to you for any loss or damage suffered by you arising from:
    1. a)  Any delays or failures in the postal service or other delivery methods used by CFP, Parentkind Enterprises Ltd, Parentkind or you from time to time
    2. b)  Any delays or failures in any systems used by CFP, Parentkind Enterprises Ltd, Parentkind or you to transmit emails
    3. c)  Any failure in any software of other systems used by CFP, Parentkind Enterprises Ltd or Parentkind for the administration of the Lottery
    4. d)  Any delays or failures in the banking system used by CFP, Parentkind Enterprises Ltd, Parentkind or you
    5. e)  Any refusal by CFP to accept registration of an individual as a Player or the cancellation of a Player by CFP
    6. f)  Any event beyond the reasonable control of CFP and Parentkind Enterprises Ltd or Parentkind
  2. 13.2  Neither CFP, Parentkind Enterprises Ltd, Parentkind or any of the beneficiaries participating in the Lottery from time to time shall be liable to you in contract, tort, negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Lottery (including loss of the opportunity to enter the Lottery, it’s Draws and/or the chance of winning a prize)
14. Intellectual Property Rights
  1. 14.1  Parentkind Enterprises Ltd own all Intellectual Property Rights in The Parents Lottery and all marketing materials provided to the organisations through The Parents Lottery or directly from Parentkind Enterprises Ltd or Parentkind
  2. 14.2  Parentkind Enterprises Ltd do not own the beneficiaries Logo but you give permission for this to be included on our marketing materials for The Parents Lottery and use on The Parents Lottery website.
  3. 14.3  Parentkind Enterprises Ltd give registered beneficiaries permission to use the marketing materials provided for the promotion of The Parents Lottery in Great Britain
  4. 14.4  Parentkind Enterprise Ltd warrant that The Parents Lottery and marketing materials that we may provide for the beneficiaries’ use (excluding the beneficiaries branding) do not infringe the rights, including any Intellectual Property Rights, of any third party
  5. 14.5  Your organisation gives us a non-exclusive and royalty-free licence to use your logo and any materials that you provide to us for the promotion of The Parents Lottery in Great Britain
  6. 14.6  Your organisation warrant that your logo and any materials that you provide to us do not infringe the rights, including any Intellectual Property Rights, of any third party
  7. 14.7  As prescribed in 5.3 and 5.4 above, upon termination of registration in The Parents Lottery your organisation will cease to use any promotional materials provided by Parentkind Enterprises Ltd with immediate effect
15. Data Protection and Privacy
  1. 15.1  Parentkind Enterprises Ltd will collect and process beneficiary and personal information in order to conduct the weekly Lottery and it will be shared with Parentkind Enterprises Ltd’s agents to the extent necessary for the weekly Lottery to be administered.
  2. 15.2  Names and other personal details from Lottery registration will be collected and stored by Parentkind Enterprises Ltd’s parent company, Parentkind, and held in accordance with the applicable privacy policy in place from time to time.
  3. 15.3  Parentkind Enterprises Ltd and/or Parentkind will send beneficiaries marketing material, information and invitations to take part in research outside the scope of the Lottery, that they have explicitly consented to receive.
  4. 15.4  Parentkind Enterprises Ltd and Parentkind will remain the Data Controller at all times
  5. 15.5  Parentkind Enterprises Ltd and Parentkind will not share Players personal data with the beneficiaries registered with the Lottery
  6. 15.6  CFP will, in conjunction with Parentkind Enterprises Ltd and Parentkind, be a Data Processor for the Lottery
  7. 15.7  Our Privacy Policy can be found on our website www.theparentslottery.org
16. Confidentiality
  1. 16.1  During the registration period, and for a period of five (5) years after registration termination, neither party will disclose to any person or legal entity, any Confidential Information of the other party or its group companies, except as permitted by law and;
  2. 16.2  Confidential Information may be disclosed by a party
    1. a)  to its employees, officers, representatives, contractors, subcontractors or advisers or those of its group companies, who need to know such information for the purposes of exercising the party’s rights or carrying out its obligations under or in connection with these T&Cs. Each Party will ensure that its Representatives, to whom it discloses the other party’s Confidential Information comply with Section 14
    2. b)  As may be required by Applicable Laws, a court of competent jurisdiction, any governmental or regulatory authority or the rules of a relevant stock exchange.
  3. 16.3  No Party will use the other party’s Confidential Information for any purpose other than to exercise its rights and perform its obligations under or in connection with these T&Cs
17. Force Majeure
  1. 17.1  Parentkind Enterprises Limited will not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform any of its obligations under these Terms and Conditions due to delay or failure resulting from events, circumstances or causes beyond our reasonable control.
